A Last Will is commonly called a “will”, “testament” or “Last Will and Testament”. The Wills Act 7 of 1953 uses the term “will” and defines it broadly enough to include a codicil and other testamentary writing.
A codicil is not simply another name for a will. It is a separate testamentary document used to add to, amend or supplement an existing will, and it must comply with the applicable legal formalities.
You may also hear the term “holograph will” used for a handwritten will. Handwritten wills are permitted in South Africa, but they must still comply with the execution requirements in the Wills Act.
