About this Notice

Wealth and Legacy Group (Pty) Ltd (registration 2014/007177/07, FSP 45445) processes personal information in connection with our website, financial and fiduciary services and business activities. This Notice applies where we act as the responsible party under POPIA. It does not automatically cover other legal entities.

Information we process

Depending on the relationship, information may include names and contact details, identity and beneficial ownership records, financial and banking information, investment and tax details, client instructions, correspondence, family and estate information, employment and supplier records, and, where lawfully relevant, health or children’s information. Information may come from you, authorised representatives, professional advisers, financial institutions, product providers or other lawful sources.

Purposes and lawful grounds

We use information to respond to enquiries, establish and manage relationships, provide financial and fiduciary services, assess suitability, implement instructions, meet identity-verification and other regulatory requirements, prevent fraud, manage disputes and maintain records. Processing is based on an applicable ground under POPIA, not necessarily consent. Providing website enquiry details is voluntary, but information needed for a service or legal duty may be mandatory; without it, we may be unable to proceed.

Recipients and service providers

Where legally permitted, information may be disclosed to product providers, insurers, banks, administrators, professional advisers, regulators and authorised service providers. Our business technology may include cloud, communications, recording, transcription and AI-assisted services for appropriately authorised activities. Confidential information remains subject to applicable legal, professional and contractual restrictions, including prior written authority where required.

International processing

Some authorised service providers may process, store or access personal information outside South Africa, including through international cloud and communications services. Transfers take place on an applicable ground under POPIA. Where adequate protection is relied upon, we assess relevant legal or contractual protections, including safeguards for further transfers. The countries involved and level of protection depend on the services and arrangements concerned; you may request further information from our Information Officer.

Website information and cookies

Our website services process information needed for hosting, enquiries, security and spam prevention, which can include IP addresses and other technical usage information. Cookies and similar technologies may support website functions and usage statistics, subject to the services enabled on the site. A website form supplies your name, email address and message so we can respond and keep relevant records. External platforms linked from the website have their own privacy practices.

Security and retention

We implement reasonable organisational and technical safeguards but cannot guarantee absolute security. Personal information is kept for applicable service, business, contractual and legal retention periods and is securely destroyed or de-identified when no longer justified.

Your rights

Subject to applicable law, you can request confirmation and access, correction or deletion, object to certain processing, and withdraw consent where applicable. Access to records under PAIA is dealt with under our PAIA Manual. You may also complain to the Information Regulator (South Africa) through its official website; contacting us first is not a prerequisite.

Communications

We contact people regarding enquiries and ongoing services. Electronic direct marketing, if undertaken, is subject to applicable consent or existing-customer provisions and an appropriate opt-out mechanism.
