How much does it cost to set up a family trust in South Africa?

There is no prescribed market price for establishing a family trust in South Africa. Professional fees depend on the complexity of the trust deed, the advice required, the number and nature of the parties, and whether the trust forms part of a wider estate, tax or business planning exercise.

The Master of the High Court charges a prescribed fee for lodging a new inter vivos trust instrument. As at September 2026, the prescribed fee is R250. Because prescribed fees can change, the current amount should be confirmed on the Master’s website at the time of registration.

Other costs may include professional drafting and advice, independent trustee fees where applicable, accounting and tax compliance, banking costs and ongoing trust administration. If assets are transferred to the trust, additional transaction costs and taxes may arise, including conveyancing costs, transfer duty or VAT on property transactions, capital gains tax, securities transfer tax or other applicable charges. An itemised quotation based on the proposed structure is more useful than a generic establishment cost range.

Wealth and Legacy Group can assist with establishing a trust and provide a quotation based on the proposed structure and the work required.
